Agreement on granting the right to use digital products on the website https://pavlunin.com.

1. General provisions

1.1. Vladimir Vladimirovich Pavlunin, self-employed (Russian Federation), Taxpayer ID (INN) 732590641535, Ulyanovsk, Russia (the “Seller”) offers any person (the “Buyer”) to enter into an agreement on the terms of this offer (the “Agreement”). This offer is a public offer (Clause 2 of Article 437 of the Civil Code of the Russian Federation).

1.2. The Agreement is concluded at the moment the order is paid: payment constitutes full and unconditional acceptance of the offer (acceptance, Clause 3 of Article 438 of the Civil Code of the Russian Federation).

1.3. The Seller applies the special tax regime “Professional Income Tax” (Federal Law No. 422-FZ of 27 November 2018).

2. Definitions

2.1. Digital product (the “Product”) — an archive with materials in electronic form (texts, checklists, templates, configurations, examples, learning materials) placed in the “Products” section of the Site.

2.2. Product page — a page of the Site with a description of the Product: contents, file format, version, license types and prices.

2.3. License — the scope of rights to use the Product selected by the Buyer when placing the order (for example, for personal use, for a team, for a company).

3. Subject of the Agreement

3.1. The Seller grants the Buyer, for a fee, the right to use the Product under a simple (non-exclusive) license to the extent specified on the Product page for the selected License and in the license file inside the archive (if any), and the Buyer pays for the Product.

3.2. The exclusive rights to the Product remain with the Seller. The Buyer may not publish, resell or distribute the Product or any parts of it separately from the Buyer's own work results, unless this is expressly permitted by the License.

3.3. The characteristics of the Product, its contents and consumer properties are specified on the Product page. The Product is an informational material and does not guarantee any particular result of its application.

4. Placing an order

4.1. The Buyer selects the Product and the License on the Product page, provides an email address for receiving the Product and, if available, a promo code, gives consent to the processing of personal data and clicks “Pay”.

4.2. The Buyer proceeds to the page of the Robokassa payment service and pays for the order. An unpaid order does not give rise to obligations for either party.

4.3. The Buyer is responsible for the correctness of the email address provided.

5. Price and payment procedure

5.1. The price of the Product is indicated on the Product page in rubles, taking into account applicable discounts and promo codes, and is fixed at the moment of proceeding to payment. The price is not subject to VAT.

5.2. Payment is made as a single payment of 100% of the price through the Robokassa payment service by bank card, via the Faster Payments System (SBP) or by any other method available on the payment page. Payment details are entered on the payment service's side and are not transferred to the Seller.

5.3. The payment obligation is deemed fulfilled from the moment the payment is confirmed by the payment service.

5.4. The Seller generates a receipt in accordance with Federal Law No. 422-FZ and sends it to the Buyer's email address.

6. Provision of the Product

6.1. The Product is provided in electronic form: after the payment is confirmed, the Buyer receives a personal link to download the archive — on the order page and at the email address provided. This usually happens within a few seconds, but no later than 24 hours from the moment of payment.

6.2. The link is valid for 30 calendar days from the moment it is issued. The Buyer saves the archive on their own.

6.3. Updates to the Product within the major version specified on the Product page (for example, 1.x) are provided free of charge via the same link or upon request.

6.4. If the link has not been received or has stopped working, the Seller issues a new link within 1 business day upon the Buyer's request.

6.5. The Seller's obligation to provide the Product is deemed fulfilled at the moment the download link is issued. The cost of delivering the Product is included in the price.

7. Withdrawal from the Agreement and refunds

7.1. The Buyer has the right to withdraw from the Agreement and receive a full refund of the amount paid within 14 calendar days from the date of payment without giving any reason.

7.2. After 14 days, the Buyer has the right to demand a refund of the amount paid if the archive cannot be opened or the Product does not correspond to the description on the Product page and the Seller has not remedied the defect within 10 calendar days from the date of the Buyer's request.

7.3. Refund procedure:

  1. The Buyer sends a request to vladimir@pavlunin.com or via the form on the “Contact” page with the subject “Refund”, specifying the email address under which the order was placed, the date of payment and, if available, the order number.
  2. The Seller confirms receipt of the request by a reply email within 1 business day.
  3. The Seller processes the refund through the Robokassa payment service using the same method by which the payment was made, no later than 10 calendar days from the date of receipt of the request. If a refund by the same method is impossible, the funds are transferred to the bank details specified by the Buyer in the request.
  4. The time it takes for the funds to be credited to the Buyer's account depends on the Buyer's bank and usually ranges from 1 to 5 business days from the date the refund is processed.

7.4. The entire amount paid is subject to refund. Fees of the payment service and the bank are not withheld from the refunded amount.

7.5. From the date of the refund, the Agreement is deemed terminated, and the right to use the Product ceases.

7.6. This section does not limit the rights of a Buyer who is a consumer under the consumer protection legislation of the Russian Federation.

8. Liability

8.1. The parties are liable for non-performance of the Agreement in accordance with the legislation of the Russian Federation.

8.2. The Seller is not liable for the inability to receive the Product for reasons on the Buyer's side: an incorrectly specified email address, the operation of the email service, restrictions of the Buyer's network. In these cases, the Seller issues the link again under Clause 6.4.

9. Personal data

9.1. To perform the Agreement, the Seller processes the Buyer's email address and order information in accordance with the Personal Data Policy.

10. Dispute resolution

10.1. Claims are sent to vladimir@pavlunin.com. The response time is 10 calendar days from the date of receipt.

10.2. Disputes not settled through the pre-trial claim procedure are resolved in accordance with the legislation of the Russian Federation.

11. Term and amendment of the offer

11.1. The offer is valid from the date specified at the beginning of the document until it is withdrawn. The Seller has the right to amend the offer; amendments do not apply to Agreements concluded before the publication of the new version.
